copyright  &  Permissions  policy

 Let's keep this simple:  If you do not ask, you are not allowed.  
As an internationally distributed artist, I've had my (un)fair share of infringement and with guidance from my copyright attorney we've been able to keep it to a minimum and recoup our costs to do so.  The internet facilitates both policing and the theft, so we hope you will understand our need to be protective.

That being said,  I do want to share and I do often grant permission when someone asks first.  If you are going to ask you must be able to satisfy the following stipulations:

  • The image or content may not be altered without permission.
  • Attribution of the content must include a clearly visible, clickable link back to my site.  All images must directly link back to my site.
  • If you seek to have your content shared, you will need to ensure that these stipulations follow the intellectual property.   As an example, if you blog about my art and I let you use a photo and another blogger asks to share your post then you need to require the photo of my art both credits and links back to me, not to you.  I reserve the right to revoke your use for failing to do so.
  • When using my written content, only excepts will be allowed.  No article, post, DIY, recipe or other written content may be used in its entirety.
  • If you would like to use my intellectual property, please email me your contact information and a description of what content you seek use of.

Site Use:
By accessing or using my site you are consenting to my policies.  If you do not like them, you are free not to use my site.  None of the imagery or authored content in this site may not be used without my permission.  My site does not contain copyright free or creative commons content.

Fair Use:
Be warned, as the copyright holder I reject any claims to fair use.  By using my site you consent to my policies and my  policies do not allow content use without permission, period.

Social Media:
If you use the social media share buttons my site provides to transmit my content to a social media site, I grant permission for the subsequent use for non-commercial purposes only.  Those buttons will provide attribution and a link back to my site.  If the links or attribution is removed or separated from the property then all permissions are revoked.  

Blogs:
If your blog contains advertising or you receive any form of compensation in kind or monetarily then your blog is a business activity.  I'd suggest you consult an intellectual property attorney before you even speak the words "Fair Use".  It has a very finite definition that the court reserves for special conditions, a bar that a profit seeking business is hard pressed to qualify for.  Be aware that most newspapers, magazines and large blogs seek permission before they use someone else's content.

Statement:
Sorry to be a hard nose about this but as usual a few bad people ruin it for the rest of us, so rules must be enacted.
